I am therefore compolled to commence upon Inland Lot No. 671 or, in default of this, to bring soil from a distance at greatly increased cost and also lose the opportunity, which is of vastly more importance, of balancing the deficiency in the Marine by the surplus on Iuland Lot No. 671 and thereby enhancing its value ten fold by cutting it down to the level of the Sea.

The annual payments I have made, with interest, now amount to $1.50 per foot of the whole lot. This is very much in excess of the value of the hill portion, but not of the lots close to it on either side of Middle Street, upon the level of the Praya. I claim the right, as it has ever been my intention, to cut down this lot level with the road to

the North of it.

I enclose copy of Government Sale Plan dated 28th June 1861 and extracts from Correspondence dated 1st, 11th, 18th and 15th October 1875. From this you will see that the road to the South of Inland Lot No. 671 was clearly delineated upon the Sale Plan, a promise being given at the Sale by the Surveyor General that it should be made. The Crown Lease also which I hold, dated 14th June 1862, states that the Lot is "abutting on the South side thereof on a Public "Street and measuring thereon one hundred feet." You will observe that the Government has refused to make any compensation in the matter, stating definitively in the letter of 11th October 1875‡that "the Street, on the absence of which you rest your claim, is at the present "moment being made." I therefore claim not only my depth from Middle Street of 225 feet but also an easement of 30 feet of roadway as the Southern boundary.

The prevention of cutting upon Inland Lot 671 has been one of the causes of the slow progress of the work of reclamation at West Point, which would have gone on much more rapidly had the cutting been made on two sides.

I inclose copy letter from the Survey Department dated 5th instant,§from which you will see that my requirement of the earth is really urgent and that I am compelled, in justice to myself, in the absence of any other means, to utilize the supply which has so long lain close at hand but which, in deference to the Military authority, I have hitherto avoided.
